Thomas Cook (MT) files for bankruptcy

European Regulation 261/2004 was established in 2005 to protect the rights of passengers subjected to flight problems such as delays and cancellations. Your rights are protected by this regulation if you fly from an EU country or into an EU country with a European airline. Thomas Cook is a European airline meaning all flights operated by this airline are covered by Regulation 261/2004.

Extraordinary circumstances and your right to compensation

Airlines regularly state that a flight is cancelled due to an ‘extraordinary circumstance’. In the event of such a circumstance they are not obliged to pay the financial compensation you would otherwise be entitled to. Regulation 261/2004 clearly specifies what constitute as an ‘extraordinary circumstance’. Examples are strikes, bad weather conditions, medical emergency landings and terrorism.

Example: Your Thomson flight from Manchester to Punta Cana, Mexico is cancelled because of a tropical storm. Poor weather conditions are considered to be extraordinary, therefor you are not entitled to compensation.
