Regulation 261/2004 was established by the European Union to protect passenger rights. Passengers faced by disruption due to a flight delay, cancellation, missed connection and denied boarding can claim compensation due to the loss of time. A few rules apply when requesting compensation.
- The arrival delay must be three hours or more
- Your flight must depart from an EU country or
- You must be flying to an EU country with a European airline
As Malaysia Airlines is not a European airline, you can only claim compensation for a flight that started in the EU. If your flight was delayed for more than three hours, you could be entitled to compensation going up to €600 per person unless extraordinary circumstances apply.
Example: Your flight with Malaysia Airlines from London Heathrow to Kuala Lumpur was delayed for eight hours by operational reasons. You are not entitled to compensation because England is not an EU country.
Amount of compensation
The amount of compensation is determined by the distance of the flight. As Malaysia Airlines only performs long-distance flights, passengers are likely to be entitled to €600 per person.
