British Airways flights delayed on 2 and 3 January
On 2 and 3 January 3 British Airways (BA) were subject to a lengthy delay. On Sunday 2 January, flights BA 2203 from London Gatwick (LGW) to Cancún (CUN) and BA 2202 from Cancún (CUN) to London Gatwick (LGW) were significantly delayed. If your British Airways flight was delayed you could end up waiting a long time at the airport and lose significant time or miss important affairs. This is why Regulation 261/2004, introduced in 2005, and amended after Brexit to the The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019 has been set in place to uphold your rights as airline passenger. In order to claim compensation for a delayed flight, the arrival delay must exceed three hours.
In the case of British Airways, the route of your flight will determine whether you fall within the scope of the EC Regulation 261 or The Air Passenger Rights and Air Travel Organisers’Licensing Regulations 2019. This means that if your flight arrives with a delay exceeding three hours and no extraordinary circumstances apply, you are entitled to compensation which can add up to €600 or £520 per person.
Example: Your flight with British Airways from New York to London Heathrow is delayed because of a technical fault. You arrive in London with a delay of almost five hours. You are entitled to a compensation of £520 per person.

Amount of compensation
When you are entitled to compensation because your British Airways flight was delayed, the amount of compensation is based on the flight distance:
Calculate the distance of your flight
- €250 (£220) compensation for a delayed flight up to 1,500 km
- €400 (£350) compensation for a delayed flight exceeding 1,500 km
- €600 (£520) compensation for a delayed flight exceeding 3,500 km
If your flight exceeds 3,500 km and your arrival delay is between three and four hours, you are entitled to 50% of the compensation amount.
